whilst I appreciate your post, both times. and I understand that certain things require specific manual updates, I thought ebooks(as in publishing) was a technology transfer issue, so would still be covered by the fundamentals of does it cause confusion, does holder suffer loss. (just like piracy of cds(not like pirating dvds which was a whole cia crazy thing))
I welcome set precedent that it requires manual transfer... as I say I'm well crusty at this.

So no, they don't have a right to defend it because they don't have it.


The BBC report beggs to differ and with out looking at the terms of thier IP Registration or looking at the Nice classification on which it's filed under it's impossible for you to presume they havn't filed an overseas application.

@ Bara, I did read your post, what i was pointing out is that GW were succusful in gaining a TM on the subject despite it been used previously by others.

Also the masses of research you have clearly done on the subject???? you seem to have missed the fact that GW have held a US TM on the use of Space Marine since 1991. The only gray area is if the TM which was on books and games auto covers ebooks when GW moved into that field.

Intrigued by whether tha means its now a game of chicken or if GW just got pwnd.

I'm M.C.A. Hogarth and I'd like to tell you how the EFF helped protect my work and the idea of a "space marine" from a shameless legal bully.

I wrote a web serial called Spots the Space Marine as an homage to Heinlein and the greats of science fiction. Crowdfunding allowed me to launch print and e-book editions that I made available on Amazon... until a trademark threat from Games Workshop over the term "space marine" caused Amazon to remove the ebook from its virtual shelves.

I made an honest effort to find out what it would take to fight the legal battle. Even more than wanting to save Spots the Space Marine, I wanted to save all space marines for the genre I grew up reading. I wanted there to be a world where Heinlein and E.E. Smith's space marines could live alongside mine and everyone else's. No one should have the hubris to think that they can own a fundamental genre trope and deny it to everyone else.

But that legal fight would have cost a lot of money -- money I didn't have. I shared my story, put out a call for support, and the lawyers at EFF answered the call.

Spots is now available on Amazon again, and I have the justice-seeking community of the Internet to thank for rallying behind me and the idea that anyone should be free to write a story about space marines or any other common term.

I reckon GW will now escalate this, then we will see if the have an american TM!
